Drugs Listed in Subsection (k) of 893.135 (Mandatory Minimums)

Phenylethylamine is a natural stimulant found in the human brain; however, it is also used as a recreational drug to trigger euphoria and pleasure on the street. The drug works by stimulating the release of norepinephrine and dopamine. The effects of phenylethylamine are similar to MDMA and THC. They include increased focus, altered perception, nausea, sweating, increased heart rate, and tightness in the throat. Numerous controlled substances related to phenylethylamine are prohibited to traffic under subsection (k) of Florida Statute 893.135. Many falsely believe drug trafficking charges are reserved for large drug operation rings; however, an individual can be charged with a relatively small amount of drugs. The Orlando area drug trafficking lawyers at Hanlon Law are ready and prepared to fight against these charges. We have valuable experience protecting those facing drug crime charges and work tirelessly for our clients.

Amount of Morphine Imprisonment Fine
20 - 200 grams 3 year minimum $50,000

Defenses to Charges for Trafficking Phenethylamines

Being charged with drug trafficking can be frightening. It is essential to contact a drug crimes lawyer to develop the most vigorous defense in your favor. One defense strategy would be to investigate the police conduct in your case. The constitution provides certain protections during a police search and seizure. If these protections were violated, your attorney might be able to have the evidence used against you thrown out by filing a motion to suppress.

Another possible defense strategy for drug trafficking charges is showing there is insufficient evidence of one element of the crime. The prosecution must prove beyond a reasonable doubt that phenethylamine trafficking has occurred. Your defense attorney may be able to show that the prosecution does not have sufficient evidence on a particular element of the crime failing to prove the accused offense beyond a reasonable doubt.

In certain drug cases, law enforcement officers may have coerced or enticed someone to engage in certain illegal activity that they may have otherwise not committed. If law enforcement was guilty of entrapment in your case, the court might dismiss the charges pending against you.

Although not a defense strategy, substantial assistance is when the prosecutor asks the court to reduce or suspend a sentence of a person convicted of drug trafficking when they are able to provide significant aid in the identification, arrest, or conviction of another person involved in drug trafficking. Suppose the person who makes this deal cannot deliver the specified information in a fixed period. In that case, they will be required to serve the applicable mandatory minimum sentence.
